TERMS OF SERVICE

These Terms of Service govern access to and use of lamplighterkids.com and the products, downloads, content, communications, and services directly offered through it.

The Site is operated by EverThread Studio LLC, a California limited liability company, under the Lamplighter Kids and Lamplighter Kids Stories brands.

By accessing the Site, placing an order, downloading a product, creating an account, or using a Service, you agree to these Terms of Service and to the policies incorporated into them.

If you do not agree, do not use the Site or Services.

1. DEFINITIONS

In these Terms:

- “Company,” “Lamplighter Kids,” “we,” “us,” and “our” mean EverThread Studio LLC.
- “Site” means lamplighterkids.com and its Shopify storefront.
- “Services” means the Site and the products, downloads, resources, accounts, support, and other services we directly provide.
- “Content” includes stories, recordings, videos, songs, artwork, illustrations, characters, text, downloads, printables, product designs, logos, and other materials.
- “You” means the person accessing or using the Site or Services.

2. ADULT-MANAGED COMMERCE

Lamplighter Kids creates stories and resources that children may enjoy with an adult.

Purchases, customer accounts, subscriptions, marketing signups, payment, membership management, contact forms, and support requests must be completed or managed by an adult with legal authority to do so.

A child should not independently:

- Place an order
- Create an account
- Join a membership
- Submit payment information
- Subscribe to marketing
- Send identifying personal information

Adults are responsible for supervising a minor’s use of public content and for deciding which stories, activities, products, and third-party services are appropriate for their family.

3. ACCOUNTS AND INFORMATION

You agree to provide accurate and current information when placing an order, joining a list, creating an account, or requesting support.

You are responsible for:

- Protecting login credentials
- Restricting unauthorized account access
- Updating contact and payment information
- Activity conducted through your account
- Notifying us of suspected unauthorized use

We may suspend or terminate an account when reasonably necessary to address:

- Fraud
- Abuse
- Security concerns
- Illegal conduct
- Policy violations
- Unauthorized commercial use
- Harm to the Site, Company, or another person

4. PRODUCTS AND SERVICES

Products and Services may include:

- Physical books
- Digital Letters from Momo
- Downloadable bundles
- Printable activities
- Audio or video products
- Lamplighter Kids Club information and access links
- Support contributions
- Preorders
- Crowdfunding rewards
- Other story-related products or resources

Product descriptions, prices, images, availability, and benefits may change.

A product is subject to the description and terms displayed when the order is placed.

We may:

- Limit quantities
- Correct a listing error
- Decline an order
- Cancel a fraudulent or unavailable order
- Discontinue a product
- Restrict a product to specific locations
- Update a price before a future purchase

If we cancel a paid order, we will refund the canceled amount.

5. PRICES, PAYMENT, AND TAXES

Prices are displayed in the currency shown on the Site.

Applicable shipping charges and taxes are displayed during checkout when available.

You authorize the applicable payment provider to charge the selected payment method for:

- Product price
- Shipping
- Taxes
- Other clearly disclosed charges

We are not responsible for fees imposed independently by:

- A bank
- Card issuer
- Payment provider
- Currency-conversion provider
- Customs authority
- Foreign government

A purchase is not complete until payment is accepted.

6. PHYSICAL PRODUCTS

Physical-product availability, delivery, returns, and replacements are governed by:

- The applicable product page
- Our Shipping Policy
- Our Refund, Return, and Cancellation Policy
- Any campaign-specific terms
- Applicable law

Jerome’s Journey is currently shipped within the United States only and may take up to three weeks to arrive after purchase.

Third-party printing, fulfillment, and shipping providers may be used to complete an order.

7. DIGITAL PRODUCTS

A digital product is licensed, not sold as intellectual property.

After payment, we grant the purchaser a limited, revocable, non-exclusive, non-transferable license to use the digital product for personal, noncommercial family use.

Unless a product page expressly permits broader use, you may:

- Download the purchased files
- Store a reasonable number of personal backup copies
- Print a reasonable number of copies for use within the purchasing household
- Use the materials privately with your family

You may not, except where law expressly permits:

- Resell a digital product
- Redistribute it
- Share the file publicly
- Upload it to a public drive, website, social platform, marketplace, or file-sharing service
- Provide copies to another household, classroom, organization, or business
- Remove copyright, trademark, or attribution notices
- Claim the work as your own
- Use it in a commercial product or service
- Create or sell derivative products
- Use it for text mining, data mining, machine-learning training, model training, dataset creation, or similar automated extraction
- Circumvent access controls

Educators, churches, schools, libraries, organizations, and commercial users should contact lamplighterkids@gmail.com before using a product beyond one household.

8. LAMPLIGHTER KIDS CLUB

Lamplighter Kids Club is currently offered through Patreon.

Patreon is responsible for its platform, payment processing, account system, billing mechanics, and platform-level terms.

The Lamplighter Kids Club page on the Site explains the membership, but member access and billing are handled through Patreon.

Membership benefits are limited to the benefits described on the active membership page or in an applicable fixed-term reward.

Ongoing membership features may change as the library, production system, and member experience develop.

We will not intentionally reduce a benefit already purchased or specifically promised for a fixed campaign or reward period without providing the notice, replacement, credit, refund, or other remedy required by the applicable terms and law.

Core public podcast and YouTube stories remain free under the current operating plan, but this statement does not require us to maintain every platform, episode, or release schedule indefinitely.

A recurring Patreon membership continues until canceled through Patreon.

A creator gift, Kickstarter reward, or prepaid access period does not automatically become a paid recurring membership unless the adult affirmatively chooses paid continuation.

9. SUPPORT CONTRIBUTIONS

The Site may allow adults to make a voluntary payment to support the creation of Lamplighter stories and related work.

Unless a specific offer states otherwise:

- A support payment is not a purchase of equity
- It does not create voting or management rights
- It is not a loan
- It does not guarantee a particular story, release, product, or schedule
- It is not represented as a tax-deductible charitable donation
- It is governed by the Refund, Return, and Cancellation Policy

Support invitations are directed to adults.

Children are never responsible for purchasing, donating, or persuading an adult to contribute.

10. CROWDFUNDING, PREORDERS, AND REWARDS

Kickstarter, BackerKit, preorder, and other campaign transactions may be governed by:

- The campaign page
- Reward descriptions
- Campaign updates
- Surveys
- Platform terms
- Fulfillment communications
- Applicable law

Crowdfunding involves project and production risk.

Images, prototypes, plans, schedules, specifications, and delivery estimates may change during development.

Any fixed campaign promise remains subject to its applicable campaign terms and legal obligations.

When campaign-specific terms conflict with these general Terms, the campaign-specific terms control for that reward or transaction.

11. INTELLECTUAL PROPERTY

The Site and Content are owned by or licensed to EverThread Studio LLC and are protected by copyright, trademark, trade dress, unfair-competition, and other laws.

Protected material includes, without limitation:

- Lamplighter Kids
- Lamplighter Kids Stories
- Momo McSquirrel
- Letters from Momo
- Stories and scripts
- Audio recordings
- Songs and lyrics
- Character voices
- Illustrations
- Animation
- Videos
- Books
- Printables
- Product artwork
- Logos
- Page copy
- Downloads
- Site design

No right, title, or interest is transferred except for the limited personal-use license expressly stated for a purchased digital product.

You may not use our names, logos, characters, artwork, audio, video, or other Content for commercial, promotional, political, machine-learning, or merchandise purposes without written permission.

12. REVIEWS, FEEDBACK, AND ORDINARY MESSAGES

We do not claim ownership of an ordinary customer-service email or private family message.

You give us permission to use the information only as reasonably necessary to:

- Respond
- Provide support
- Fulfill a request
- Administer an order
- Investigate a problem
- Maintain records
- Comply with law

If you voluntarily submit a public review, testimonial, or comment, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, format, and share that submission in connection with Lamplighter Kids, subject to applicable privacy law.

We will not publicly identify a child from a private family message without appropriate adult permission.

13. CHILD AND FAMILY SUBMISSIONS

A family message to Rebecca or Momo must be sent or supervised by a grown-up.

Do not send a child’s:

- Full name
- Home address
- School
- Birthday
- Telephone number
- Personal email address
- Account password
- Medical information
- Precise location
- Photograph or video unless a specific adult release process has been provided

Any future fan-mail, contest, art, video, or story-submission program may have separate rules, permissions, and releases.

Those separate rules will control for that program.

14. UNSOLICITED CREATIVE SUBMISSIONS

Please do not send unsolicited:

- Manuscripts
- Story ideas
- Character concepts
- Scripts
- Songs
- Lyrics
- Illustrations
- Product ideas
- Animation concepts
- Business proposals involving creative ownership

We may already be developing similar ideas.

Unless we specifically request a submission under written submission terms:

- We have no obligation to review it
- We have no obligation to keep it confidential
- We have no obligation to compensate the sender
- Receipt does not create a creative, fiduciary, employment, partnership, or contractual relationship

This section does not give us ownership of an unsolicited submission.

15. PROHIBITED USE

You may not use the Site or Services to:

- Violate law
- Infringe intellectual-property or privacy rights
- Submit fraudulent orders
- Impersonate another person
- Collect information about other users
- Transmit malware or harmful code
- Interfere with Site security or operation
- Scrape or copy the Site at scale
- Circumvent checkout, access, or download restrictions
- Resell products without authorization
- Harass, threaten, exploit, or harm another person
- Submit sexual, violent, hateful, defamatory, or otherwise unlawful content
- Use Content to train an artificial-intelligence or machine-learning system
- Use the Site in a way directed toward exploiting or manipulating children
- Use an automated system that places an unreasonable burden on the Site

We may investigate and take reasonable action in response to suspected misuse.

16. THIRD-PARTY SERVICES AND LINKS

The Site may contain links to or embedded content from third parties, including:

- Shopify
- Patreon
- Kickstarter
- BackerKit
- YouTube
- Spotify
- Apple
- Podcast applications
- Yoto
- Storybutton
- Storynest
- Payment services
- Shipping providers
- Social-media services

A third-party service is governed by its own terms, privacy policy, availability, and technical operation.

We do not control and are not responsible for a third party’s:

- Content
- Privacy practices
- Security
- Billing system
- Account decisions
- Availability
- Representations
- Products
- Services

Review the third party’s terms before using it.

17. ACCURACY AND AVAILABILITY

We try to provide accurate product, story, price, shipping, and availability information.

The Site may occasionally contain:

- Typographical errors
- Outdated information
- Broken links
- Technical errors
- Incorrect availability
- Incorrect pricing
- Incomplete descriptions

We may correct an error and, when appropriate, contact an affected customer.

Historical pages, campaign updates, podcast descriptions, or archived content may describe a past offer or status that is no longer current.

18. EDUCATIONAL AND FAMILY CONTENT

Lamplighter stories, virtues, questions, activities, and family resources are provided for storytelling, entertainment, reflection, and general educational purposes.

They are not medical, psychological, legal, therapeutic, religious-clergy, financial, or professional advice.

Parents and caregivers remain responsible for evaluating:

- Age suitability
- Emotional suitability
- Family values
- Safety
- Accessibility
- Whether an activity requires adult supervision

19. CHANGES TO SERVICES

We may update, pause, replace, or discontinue a Site feature, product, platform connection, or ongoing service.

We will honor non-waivable consumer rights and specific fixed-term obligations.

We are not required to preserve a free feature or third-party distribution channel indefinitely.

20. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site, Services, and free Content are provided “as available” and without warranties not expressly stated in writing.

We do not warrant that:

- The Site will always be uninterrupted
- Every error will be corrected immediately
- Every third-party service will remain available
- Every device will support every file
- Use of a story or activity will produce a particular outcome
- A product will meet a subjective expectation not stated in its description

Nothing in these Terms excludes an express warranty or consumer protection that cannot lawfully be excluded.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, EverThread Studio LLC and its owners, officers, workers, contractors, creators, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or Services.

For a claim relating to a paid product, our aggregate liability will not exceed the amount paid for the product or Service giving rise to the claim, except where applicable law requires a different remedy.

These limitations do not apply to liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, personal injury caused by negligence, or a non-waivable consumer right.

22. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold EverThread Studio LLC harmless from a third-party claim arising from:

- Your unlawful use of the Site
- Your infringement of another person’s rights
- Your unauthorized resale or distribution of Content
- Your fraudulent conduct
- Your material violation of these Terms

This section does not require a consumer to indemnify us for our own unlawful conduct.

23. TERMINATION

You may stop using the Site at any time.

We may suspend or terminate access when reasonably necessary because of:

- A material violation of these Terms
- Fraud
- Abuse
- Security risk
- Unlawful conduct
- Harm to another person
- Unauthorized commercial exploitation

Provisions concerning payment, intellectual property, digital-use restrictions, disclaimers, liability, and dispute terms survive termination where their nature requires it.

24. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.

Subject to any non-waivable right to bring a claim elsewhere, legal proceedings relating to these Terms will be brought in a court with jurisdiction in Orange County, California.

Nothing in this section deprives a consumer of a mandatory protection or forum right provided by the law of the consumer’s residence.

25. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in law, products, practices, platforms, or operations.

The current version will be posted on the Site with a revised “Last updated” date.

A material change will apply prospectively unless law permits or requires otherwise.

Continued use after an effective change constitutes acceptance to the extent permitted by law.

26. SEVERABILITY

If part of these Terms is held unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will remain effective.

27. NO WAIVER

A delay or failure to enforce a provision does not waive the right to enforce it later.

28. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Shipping Policy, Refund, Return, and Cancellation Policy, applicable product descriptions, and any campaign-specific terms, form the agreement governing use of the Site and the relevant transaction.

29. INDEPENDENT BRAND NOTICE

Lamplighter Kids and Lamplighter Kids Stories are independent children’s storytelling brands created by Rebecca Sanderson and operated by EverThread Studio LLC.

They are not affiliated with Lamplighter Ministries or Lamplighter Theatre.
